Election 2010

With the Westminster general election having just been called for 6 May, many of us will be thinking ahead to polling day. The debate between the political parties will move up a gear over the next few weeks and they’ll all be clamouring to win our votes. Private Sector Housing Issues: Housing (Scotland) Bill - consultation analysis published

These research findings set out the key findings from the recent consultation on private sector housing issues for possible inclusion in the upcoming draft Housing (Scotland) Bill. The proposals focus on three areas: landlord registration, HMO licensing and powers in the Housing (Scotland) Act 2006 for local authorities to deal with disrepair in privately owned houses.

Section 11

Section 11 of the Homelessness etc (Scotland) Act 2003 places a duty on landlords (except local authority landlords) and creditors to notify the relevant local authority when they raise proceedings for possession or serve certain other notices.Its purpose is to give local authorities early notice of households at risk of homelessness due to eviction.

Landlord Registration Renewals

Following a public consultation which SAL has taken part in, a number of changes to the legislation underpinning registration came into force on 12th February 2009.

Caution - this information only applies to those landlords whose registration is renewable this year. This is very few as the system took so long to get landlords registered in the first place. Before doing anything, check the expiry date on your Landlord Registration documents. Also be aware that the renewal date must be a full three years later than the date of your registration being granted. Contact SAL for advice if you need to on this matter.

Energy Performance Certificates - EPCs

Since the 4th of January 2009, landlords in Scotland are now required to provide an Energy Performance Certificate (EPC) when letting a property. This is for new tenancies only and landlords do not need to carry out an EPC inspection for properties which are currently let out, until the tenancy changes.
